As we have already informed, the first release in this year in Regional school of preparation of young organizers of elections has passed and the second stream has already started.
We represent a response of one of listeners of the school:
“… the Regional school of preparation of young organizers of elections, organized by the Election commission of Rostov region has given us deep theoretical and practical knowledge which will be useful to us both as to the future participants of elective process, and in general as to people, whose future is connected with the state and municipal service. Also the Regional school has given us directions for continuation of scientific work on studying of problems of the operating elective legislation.
I was interested in a question lifted at a lecture on publicity in activity of election committees and institute of observers, concerning law enforcement problems on settlement of realization of powers in two and more observers on one polling district (one election committee) from one candidate or political party. The federal law “About the basic guarantees of election rights and the rights to participation in a referendum of citizens of the Russian Federation” with a view to maintenance of equality of the rights of candidates does not suppose simultaneous presence of several observers from one candidate or the political party participating in elections, but also does not forbid that that some observers were on duty in election committee serially. However frequently there are conflicts about that who and when should be on duty on polling district from simultaneously arrived two and more observers because of what there is a difficulty of application of the given position.
To eliminate the founded drawback in legal regulation I have offered to add to the federal elective legislation on elections and referenda positions obliging the candidate or political party, appointing two and more observers on one polling district (in one election committee), in a direction to specify beginning and termination time (time frameworks) of realization of powers of the observer by each of them on polling district (in election committee). Also it is offered to establish legislatively that at a simultaneous appearance of two and more observers if in their directions time frameworks of realization of the powers are not specified, each of them, the question on realization of powers of the observer by the concrete person, should be solved by the subject appointing the observer (the candidate or political party). If it is impossible to solve the issue in question on the day of voting powers of the observer for the time of voting should be carried out by the person, arriving before the others to the polling district (in election committee) and showing the corresponding direction.
Now this point in question is considered by the legal department of Election commission of Rostov region …”
